Emeritus Refer-a-Colleague Program Terms & Conditions
Harvard Medical School in collaboration with Emeritus Institute of Management (“Emeritus”), an online education provider, is developing and delivering the Emeritus Refer-a-Colleague program. By participating in and becoming a member of the Refer-a-Colleague program (a “Referrer”), you are subject to Emeritus’ Terms of Service and Privacy Policy, as well as the following additional Terms & Conditions for the Emeritus Refer-a-Colleague program:

Qualified Referral. A Qualified Referral is defined as a purchase made on an Emeritus course by a person (a "Referred Customer") who arrives to our website by clicking your Refer-a-Colleague program link. You are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals

Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different e-mail address)

Referral Rewards. For you to earn referral rewards as a Referrer, the Referred Customer must purchase a course and stay enrolled through our refund period.

Reward Payments. Rewards are payable in increments of course account credits. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards.

Course Account Credit Applicability. If you have already purchased an Emeritus course prior to the Qualified Referral being made, and you and Referred Customer are taking the course at the same time, we will automatically credit your reward to you. Otherwise, your credit can be put towards any future course by Harvard Medical School in collaboration with Emeritus Institute of Management.

Eligibility. Eligibility is limited to individuals only. Refer-a-Colleague programs for any Emeritus courses cannot be used by businesses for affiliate lead generation as determined in Emeritus’ sole discretion.

No Spam. You must comply with all current “SPAM” laws. For example, e-mails must be created and distributed in a personal manner and bulk e-mail distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial e-mail or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Emeritus’ Refer-a-Colleague program.

Representations. Referrer makes the following representations:

Referrer will not in any way falsify, deceive, or mislead Emeritus regarding referrals in the Refer-a-Colleague program.

Referrer will not misrepresent Referrer’s relationship with Emeritus.

Referrer will not harvest, use listed resources, or otherwise pay for leads (or personal information) for use in this Refer-a-Colleague program.

Referrer acknowledges and understands that Emeritus will rely upon Referrer’s compliance with these Terms & Conditions. Emeritus reserves the right to request to see Referrer’s e-mails about this program to confirm such compliance.

Right to Close Accounts. Emeritus reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Emeritus Refer-a-Colleague program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.

Right to Cancel Program or Change Terms. Emeritus reserves the right to cancel the Refer-a-Colleague Program or to change these Terms & Conditions at any time in its sole discretion. Changes will be effective immediately upon posting revisions to these Terms & Conditions. Any unclaimed referral rewards will be forfeited at the time the program is cancelled.

Indemnification. Referrer will defend, indemnify, and hold harmless Emeritus, its representatives, and affiliates from damages, liabilities, costs, and expenses (including attorneys' fees) resulting from any claim, judgment, or proceeding resulting from Referrer’s noncompliance with these Terms & Conditions.

Liability. Emeritus shall have no liability in connection with this Refer-a-Colleague Program to Referrers or anyone else.
